2. Introduction

TestIQ provides educational cognitive assessment and brain training features via a digital platform. By accessing or using the Service, you agree to these Terms & Conditions and our Privacy Policy.

These Terms apply across all access methods, including web, mobile, tablet, and future platform versions.

3. IQ Testing & Disclaimers

Important: The TestIQ Service is provided for educational and entertainment purposes only. It is not a clinical psychological or medical assessment tool. Results should not be used for medical, academic, or employment decisions.

Educational and Entertainment Use

The IQ score generated by TestIQ is an estimate based on our proprietary assessment methodology. It is intended for personal interest and self-exploration only. Results are not equivalent to professionally administered cognitive evaluations.

Factors Affecting Results

Results may vary and can be influenced by: device and environment conditions; physical or mental state at the time of testing; time of day, stress, or fatigue; internet connection quality; and familiarity with the testing format.

TestIQ does not provide medical, psychological, or professional advice. If you require clinical evaluation or guidance, please consult a qualified professional.

User Responsibility

Use of the Service is at your own discretion. We do not guarantee cognitive improvement and are not responsible for decisions made based on your results.

4. Acceptance of Terms

By using the Platform — including clicking "Continue" in the email collection screen — you confirm you have read, understood, and accepted these Terms.

If you do not agree with any part of these Terms, you must stop using the Service immediately.

We may update these Terms periodically. Material changes will be communicated by email or via a prominent notice at least 14 days before taking effect. Continued use after updates constitutes acceptance.

5. Account Eligibility & Security

Age Requirements

The Service is intended for users who are at least 18 years of age. By creating an account, you confirm you meet this requirement.

Prohibited Activities

You must not: create multiple accounts to bypass restrictions; share or sell account access; provide false information during registration; or attempt to circumvent security measures.

Inactive Accounts

Accounts with no activity for 365 consecutive days may be permanently deleted, including all associated data.

6. Subscriptions & Billing

Trial & Subscription Offer

$0.99 for 7 days (trial period), then $14.99/month — cancel anytime.

Unless canceled before the 7-day trial ends, the subscription automatically converts to the standard monthly plan. The first standard charge of $14.99 occurs on the day following trial expiration.

FTC Disclosure: The recurring charge of $14.99/month will begin automatically after your 7-day trial unless you cancel before the trial period ends. You will be charged to the payment method provided at checkout.

Billing

Billing occurs automatically on renewal dates using PCI-compliant payment processing via Stripe. If a payment fails, we may retry the charge and may suspend access after extended non-payment. Bank fees for declined transactions are the user's responsibility.

After cancellation, access continues until the end of the current paid period. No partial refunds are issued for unused time after a renewal charge.

7. Refund Policy

We offer a 14-day money-back guarantee on your initial purchase. If you are not satisfied, contact us at help@test-iq.site within 14 calendar days of the original transaction and we will process a full refund — no questions asked.

Refunds for trial or one-time test purchases may also be granted if all of the following apply:

Subscription Refunds

Subscription renewal charges are generally non-refundable once the billing period has started, except in cases of: billing errors or duplicate charges; unauthorized transactions; verified technical failures that prevented access to core features for a significant period.

How to Request a Refund

Email help@test-iq.site with your account email, transaction ID or payment receipt, and reason for the request. Approved refunds are returned to the original payment method within 10 business days.

8. Intellectual Property

All Platform content, software, branding, and assessment materials are owned by TestIQ (or its licensors) and protected by applicable intellectual property laws. You receive a limited, personal, non-transferable license for non-commercial use only. You must not copy, redistribute, reverse-engineer, or create derivative works from any part of the Platform.

9. User Content

You retain ownership of any content you submit to the Platform. By submitting content, you grant TestIQ a non-exclusive license to host, display, and process that content to operate and improve the Service.

You must not submit unlawful, harmful, deceptive, or infringing content.

10. Service Availability

We aim to provide reliable, uninterrupted access, but availability may be impacted by scheduled maintenance, emergency updates, or force majeure events (including natural disasters, government actions, cyberattacks, or infrastructure outages). We are not liable for service interruptions caused by events beyond our reasonable control.

12. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, TestIQ's total liability for any claims related to the Service is limited to the amount you paid to TestIQ in the 12 months preceding the event giving rise to the claim.

TestIQ is not liable for indirect, incidental, consequential, punitive, or special damages — including lost profits, lost data, or business interruption — regardless of how they arise.

You agree to indemnify and hold TestIQ and HotLead Agency, LLC harmless from any claims, damages, or expenses arising from your misuse of the Service, violation of these Terms, or infringement of third-party rights.

13. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of laws provisions.

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding individual arbitration in accordance with the rules of the American Arbitration Association. Class actions and class arbitrations are waived. Small-claims matters and intellectual property disputes may be excluded from arbitration at TestIQ's discretion.

14. Service Modifications

We may modify, suspend, or discontinue any part of the Service at our discretion. Material changes will be communicated in advance where feasible; emergency and security changes may be implemented immediately without prior notice.

15. Account Termination

You may terminate your account at any time via the self-service portal, or by contacting help@test-iq.site.

We may suspend or terminate accounts for violations of these Terms, suspected fraud or abuse, security risks, non-payment, or legal compliance requirements. Upon termination, your right to access the Service ceases immediately.
