1. Definitions

- Trial Period — a limited introductory period offered at a discounted price
- Standard Subscription — paid access that continues after the Trial Period ends
- Billing Cycle — the interval at which subscription charges occur (e.g., weekly, monthly, quarterly)
1.4 Security Terms
- Authentication Code — a time-limited, single-use verification code for account access
- Access Credentials — information or mechanisms used to confirm user identity
1.5 Force Majeure
“Force Majeure” refers to events beyond reasonable control that prevent or delay service delivery, including, for example:
- natural disasters and severe weather
- government actions, regulations, or restrictions
- war, terrorism, civil unrest
- cyber incidents or major security events
- network, hosting, or infrastructure outages
- pandemics or public health emergencies
- internet provider or power grid failures
2. Welcome and Introduction
TestIQ provides educational cognitive assessment and training features via a digital platform.
By accessing or using the Service, you acknowledge that you:
- agree to these Terms & Conditions
- accept our applicable privacy practices
- understand that the Service has limitations and is not a professional clinical tool
These terms apply across all access methods (web, mobile, tablet, desktop apps, integrations, and future platform versions).
3. IQ Testing and Training Disclaimers
3.1 Educational and Entertainment Use
The Service is provided for educational and entertainment purposes only. It is not a professional psychological or medical product.
You agree and understand that:
- results are not equivalent to clinical intelligence testing
- scores are intended for personal interest
- results should not be used for medical, academic, or professional decisions
3.2 Testing Limitations
Results may vary and may be influenced by factors such as:
- environment and device conditions
- physical or mental state
- time of day and stress
- connection quality and platform performance
- familiarity with testing format
3.3 Training Program Disclosure
Brain training activities are based on general cognitive exercise principles. Individual outcomes can differ substantially, and progression within the Platform may not translate into real-world cognitive changes.
3.4 No Professional Advice
We do not provide medical or psychological advice. If you need clinical evaluation or professional guidance, consult qualified specialists.
3.5 User Responsibility
Use of the Service is at your own discretion. We do not guarantee improvement and are not responsible for decisions or outcomes based on interpretation of results.
4. Acceptance of Terms
By using the Platform, you confirm you have read and accepted these terms.
If you do not agree with any part of the Terms, you must stop using the Service.
We may update these Terms from time to time. Where changes are material, we may notify users via email. Continued use after updates take effect constitutes acceptance of the updated Terms.
5. Account Eligibility and Security
5.1 Age Requirements
The Service is intended for users who are at least 18 years old (or the legal age required in their jurisdiction). Verification may be required in some cases.
5.2 Account Creation

You are responsible for:

- create multiple accounts to bypass restrictions

- attempt unauthorized access or security bypasses
5.6 Organizational Use
If you use the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms.
5.7 Inactive Accounts (Retention and Deletion)
To maintain security and operational efficiency, accounts inactive for 365 days may be removed.
In general:
- if you interact with the Service within the last 365 days, the account remains active
- if there is no activity for more than 365 days, the account and associated data may be permanently deleted

6. Subscription Services
6.1 Trial and Subscription Basics
Subscriptions may start with a free 7-day trial. Unless canceled before the trial ends, the subscription converts to the selected paid plan.
Key points:
- the trial price applies only during the trial window
- the standard rate begins immediately after the trial ends
- the first standard charge occurs at trial expiration
- exact pricing is presented during sign-up
6.2 Subscription Plans and Regional Pricing
Prices may vary by region, currency, and local tax requirements. You will always see the final amount displayed during sign-up, and you will be charged the amount shown at checkout.
In some regions or payment methods, the trial charge may appear as two smaller transactions that total the same trial amount.
6.3 Payment and Billing
Billing occurs automatically on renewal dates using PCI-compliant payment processing. Supported payment methods may vary by region.
If payments fail, we may retry charges and may suspend access after extended non-payment. Bank fees related to declined payments are the user’s responsibility.
6.4 Managing Your Subscription
You can cancel using:

After cancellation:
- access remains until the end of the current paid period
- auto-renewal stops
- no partial refunds for unused time after a renewal
7. Refund Policy
This Refund Policy applies to all digital services and subscriptions provided via the TestIQ platform.
7.1 General Principles
Due to the nature of digital content and instant access services, refunds are limited and provided only under specific conditions described below.
By completing a purchase, the user acknowledges and agrees that access to the service may begin immediately, which may affect refund eligibility.
7.2 Trial & One-Time Test Purchases
Refunds for trial access or one-time test purchases may be granted only if all of the following conditions are met:
- the user is a first-time customer
- the test has not been started or completed
- test results have not been generated or accessed
- no prior refund abuse is detected
- the request is submitted within 14 calendar days from the payment date
Once a test is started or results are delivered, the service is considered fully provided and becomes non-refundable, unless required by law.
7.3 Subscription Refunds
Subscription payments are generally non-refundable once the billing period has started.
Refunds may be issued only in the following cases:
- billing errors, including duplicate or incorrect charges
- unauthorized transactions
- verified technical failures that prevented access to core functionality for a significant period
- service unavailability caused by our systems (excluding scheduled maintenance)
Unused subscription time after cancellation is not refundable.
7.4 Non-Refundable Cases
Refunds will not be provided for:
- accessed or delivered test results
- change of mind or dissatisfaction with results
- failure to read product descriptions before purchase
- unused time after subscription cancellation
- downtime caused by maintenance or external factors beyond our control
7.5 Refund Request Timeframe
All refund requests must be submitted within 14 calendar days from the original transaction date.
Requests submitted after this period will not be considered.
7.6 How to Request a Refund

- reason for the request
- any relevant supporting information (if applicable)
7.7 Refund Processing
Approved refunds are processed to the original payment method.
Processing time:
- up to 10 business days, depending on the payment provider and issuing bank
7.8 Chargebacks & Abuse Prevention
We reserve the right to deny refund requests in cases of suspected abuse, repeated refund attempts, or violation of our Terms of Service.
Users are encouraged to contact support before initiating chargebacks, as unresolved chargebacks may result in account restrictions.
8. Intellectual Property Rights
All Platform content, software, and branding are owned by TestIQ (or its licensors) and protected by applicable intellectual property laws.
You receive a limited, personal, non-transferable license for non-commercial use. You must not copy, redistribute, reverse engineer, or create derivative works from the Platform.
9. User Content and Rights
You retain ownership of content you submit. By submitting content, you grant TestIQ a license to host, display, and process that content to operate and improve the Service, including for technical optimization and aggregated analytics.
You must not submit unlawful, harmful, deceptive, or infringing content.
10. Service Availability
We aim to provide reliable access, but availability can be impacted by maintenance or Force Majeure events. Maintenance windows may occur, and emergency updates may be deployed without advance notice when required.
11. Technical Requirements
The Service requires modern web standards support, JavaScript, cookies, and a stable internet connection.
Minimum device and browser requirements may change over time for security and performance reasons.
12. Customer Support and Complaints

For complaints and escalations, you may be asked to provide identifying information, a detailed description, and relevant documentation.

13. Limitation of Liability and Indemnification
To the maximum extent permitted by law, TestIQ’s total liability for claims related to the Service is limited to the amount you paid during the 12 months prior to the event giving rise to the claim.
We are not liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, lost data, or business interruption.
You agree to indemnify and hold harmless TestIQ and its affiliates from claims arising from misuse of the Service, violations of these Terms, or infringement of third-party rights.
14. Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA.
Where applicable, disputes may be subject to mandatory arbitration and individual (non-class) resolution procedures. Some matters (such as intellectual property disputes or small-claims matters) may be excluded from arbitration.
15. Service Modifications
We may modify, suspend, or discontinue parts of the Service. Material changes may be communicated in advance where feasible, while emergency or security changes may be implemented immediately.
16. Account Termination
You may terminate your account through:

We may suspend or terminate accounts for violations, fraud, abuse, security risks, non-payment, or legal compliance requirements.
